These Terms govern use of PropertyBrain (the "Service"), provided by [AIOS LEGAL ENTITY NAME], [ADDRESS] ("we", "us"). By creating an account you ("Customer") agree to them on behalf of your company.

1. The Service

PropertyBrain is software that helps property management companies answer tenant questions, take maintenance requests and route work. It uses artificial intelligence and can be wrong. Customer remains responsible for all communications with its tenants, owners and vendors and for all decisions about its properties.

2. Accounts

• You must give accurate information and keep passwords confidential.
• You are responsible for everything done under your account, including by users you invite.
• You must be at least 18 and authorized to bind your company.

3. Free pilot and plans

• New accounts get a free 2-week pilot. No payment card is required to start.
• After the pilot you must choose a paid plan (Starter, Growth or Pro) to keep using the Service. Prices are shown on our pricing page and are in US dollars, excluding taxes.
• Plans renew monthly until cancelled. You can cancel at any time in the billing portal; cancellation takes effect at the end of the current billing period. We do not give refunds for partial months except where required by law.
• We may change prices with at least 30 days' notice by email.
• If payment fails we may suspend the Service after a reasonable retry period.

4. Customer data

• You own the documents, tenant data and messages you or your tenants put into the Service ("Customer Data").
• You grant us a licence to host, process and transmit Customer Data only to provide and improve the Service, as described in our Privacy Policy and Data Processing Addendum.
• You confirm you have the rights and any notices or consents needed to give us Customer Data, including tenant phone numbers and email addresses.
• We do not sell Customer Data and do not use it to train third-party AI models.

5. Messaging (SMS and email)

• You must only message people who have agreed to be contacted, and you must comply with the TCPA, CAN-SPAM, carrier rules and the CTIA guidelines.
• Tenants can reply STOP to opt out of texts at any time. You must not re-add opted-out numbers.

6. Acceptable use

You must not use the Service to: break any law, including the Fair Housing Act and state or local fair housing laws; make tenant screening, leasing or eligibility decisions using AI output; send spam; upload malware; probe or attack the Service; or resell it without our written consent.

7. AI output

AI answers are generated automatically from the documents you upload and may be incomplete or incorrect. They are not legal, financial or safety advice. For emergencies (fire, gas, flooding, danger to life) tenants must call 911 and you must keep your normal emergency procedures in place. See /legal/ai-disclaimer.

8. Availability and support

We aim for high availability but do not guarantee the Service will be uninterrupted. Support is by email at info@propertybrain.us during US business hours.

9. Warranties disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your Customer Data, your messages to tenants, or your breach of these Terms or of law.

12. Termination

Either party may terminate at any time. On termination you may export your data for 30 days, after which we delete it as described in the Privacy Policy.

13. General
